Terms of service

These Terms of Service ("Terms") form a binding agreement between Hatchgrid Private Limited ("Hatchgrid", "we", "us", "our") and you when you use Quizzie (the "App") — our quiz application available on mobile and web.

Please read these Terms carefully. By creating an account or using Quizzie in any way, you agree to be bound by them and by our Privacy Policy.

1. The basics

• Who we are: Hatchgrid Private Limited, a company incorporated in India with its registered office in Gurugram, Haryana.
• What Quizzie is: a quiz-based entertainment application offering category quizzes, friend challenges, and group tribes.
• What this isn't: Quizzie is for entertainment. It is not a knowledge certification, an educational credential, or a real-money gaming service. We do not award cash prizes, vouchers, or anything of monetary value for gameplay.

2. Eligibility

You may use Quizzie if:

• You are at least 13 years old.
• If you are under 18, you have your parent's or legal guardian's permission to use Quizzie. By creating an account, you confirm that such permission has been obtained.
• You are legally able to enter into a binding contract under Indian law (the Indian Contract Act, 1872).
• You are not barred from using our services under any applicable law.

We may refuse service, terminate accounts, or remove content at our discretion if we reasonably believe you do not meet these criteria.

3. Your account

To use most features of Quizzie, you need an account. When you create one:

• You agree to provide accurate information (a working email or phone number for sign-in).
• You are responsible for keeping your sign-in credentials secure and for all activity on your account.
• You agree not to share your account with anyone else, or use someone else's account without permission.
• If you suspect unauthorized access, contact us immediately at quizziehelp@hatchgrid.in.

We may suspend or terminate your account for violations of these Terms, fraud, abuse, or for safety reasons. You can delete your account at any time via Profile → Delete Account.

4. Acceptable use

You agree not to:

• Use Quizzie to harass, abuse, threaten, dox, or impersonate anyone.
• Choose a username or avatar that is offensive, infringing, impersonates a real person without permission, or is misleading.
• Cheat — including but not limited to: tampering with the App's code, intercepting network traffic, using bots or automated tools to play, sharing answers in advance, or otherwise circumventing our anti-cheat measures.
• Reverse-engineer, decompile, or attempt to extract source code or secrets from the App.
• Access, scrape, or copy data from Quizzie except as expressly permitted (e.g., via your own profile).
• Use Quizzie to send spam, malware, or unsolicited messages.
• Probe, scan, or test the vulnerability of our systems without our prior written consent. (If you find a security issue, please email quizziehelp@hatchgrid.in — we appreciate responsible disclosure.)
• Use Quizzie for any unlawful purpose under Indian law.

Violations may result in warnings, content removal, account suspension, or permanent ban — at our sole discretion.

5. Quiz content and AI disclosure

Quizzie's questions are generated or curated with the assistance of artificial intelligence. This means:

• Questions may occasionally be inaccurate, unclear, or unfair despite our quality controls. We will not always be able to detect every error in advance.
• If you find a problem with a question, please flag it using the in-app reporting flow (tap any question on your result screen → "Found something off?"). We review every report and use them to improve content.
• We are not liable for any decision you make based on quiz answers (e.g., as a study aid, in a debate, or as factual research). Quizzie is for entertainment only.

All quiz questions, categories, and curated content are owned by Hatchgrid (or licensed to us) and are protected by Indian and international intellectual property law. You may not copy, redistribute, or use this content outside the App.

6. User content

When you choose a username, an avatar emoji, or flag a question, that's "User Content."

• You retain ownership of your User Content.
• By submitting User Content, you grant Hatchgrid a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, distribute, and use that content within the App and for purposes related to operating, promoting, and improving Quizzie.
• You confirm that your User Content does not infringe anyone else's rights and complies with these Terms (see "Acceptable use").

We may remove User Content that violates these Terms without notice.

7. Intellectual property

The App — including its source code, design, branding (the Quizzie name, logo, "Hatchgrid"), quiz questions, categories, gameplay mechanics, and other content — is owned by Hatchgrid or its licensors. All rights are reserved.

These Terms do not grant you any rights to our trademarks, copyrights, or other intellectual property except the limited right to use the App as described here.

8. Premium / paid features

We currently offer Quizzie for free. We may introduce paid features (e.g., a "Premium" tier) in the future. When we do:

• We will publish separate pricing and subscription terms before any payment is required.
• The payment method depends on where you obtained the App:
  • Apple App Store (iOS): purchases are processed through Apple's In-App Purchase system and are governed by Apple's terms. Apple manages billing and refunds for these purchases.
  • Google Play / web: purchases may be processed by a regulated Indian payment provider (e.g., Razorpay, Cashfree) — not by Hatchgrid directly.
• You will have a clear opt-in step before any charge.
• The applicable refund terms will be shown at the point of purchase — Apple's refund process for iOS purchases, and the relevant provider's or ours for other platforms.

This Terms section will be updated when paid features launch, and continued use of paid features after that update will indicate acceptance of those new terms.

9. Service availability and changes

We work hard to keep Quizzie running, but we don't promise uninterrupted service. We may:

• Modify or remove features at any time.
• Take the App down for maintenance, upgrades, or to fix issues.
• Stop offering Quizzie entirely (we'll give reasonable notice if we do).

We aren't liable for any losses caused by the App being unavailable, slow, or different from how it was when you started using it.

10. Termination

We may suspend or terminate your access to Quizzie at any time, with or without notice, if:

• You violate these Terms.
• We're required to by law or by a court order.
• We reasonably believe your account is compromised or being used to harm others.
• We decide to discontinue the service.

You may stop using Quizzie at any time, and you can delete your account from Delete account or in-app at Profile → Delete Account. Some provisions of these Terms (e.g., intellectual property, liability limits, dispute resolution) survive termination.

11. Disclaimers

Quizzie is provided "as is" and "as available." To the maximum extent permitted by law:

• We make no warranty that the App will be error-free, secure, uninterrupted, or that quiz content will be accurate.
• We make no warranty that the App will meet your specific requirements or expectations.
• We are not responsible for the conduct of other users — what they say, the names they pick, or how they treat you.
• We are not responsible for issues caused by your device, your internet connection, or third-party services.

If applicable consumer protection law gives you warranties we cannot lawfully exclude, those warranties continue to apply — but only to the minimum extent the law requires.

12. Limitation of liability

To the maximum extent permitted under Indian law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost opportunity, lost rank, or emotional distress — arising from your use of Quizzie.
• Our total liability to you for any claim relating to these Terms or to Quizzie will not exceed ₹1,000 (one thousand Indian rupees) or the amount you paid us in the twelve (12) months before the claim arose, whichever is greater.

These limits apply even if a remedy fails its essential purpose, and even if we were warned of the possibility of damages.

13. Indemnity

You agree to indemnify and hold harmless Hatchgrid, its officers, employees, and partners from any claim, loss, or expense (including reasonable legal fees) arising from:

• Your breach of these Terms.
• Your User Content.
• Your misuse of the App.
• Your violation of any third party's rights or applicable law.

14. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles.

Disputes: Before filing any formal legal action, you agree to first contact us at quizziehelp@hatchgrid.in and give us at least 30 days to resolve the issue informally. Most disputes can be settled this way.

If we can't resolve it informally, you agree that any dispute arising out of or relating to these Terms or to Quizzie will be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana, India.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll notify you in the App or by email at least 30 days before the changes take effect, where reasonable. The "Last updated" date at the top shows the most recent revision. Your continued use of Quizzie after the effective date means you accept the updated Terms.

If you don't agree to an updated version, your only remedy is to stop using Quizzie and delete your account.

16. Miscellaneous

• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Hatchgrid regarding Quizzie. They replace any prior agreement.
• Severability: if any part of these Terms is held unenforceable, the rest stays in effect.
• No waiver: if we don't enforce a provision, that's not a waiver of our right to enforce it later.
• No assignment by you: you may not transfer your account or these Terms to anyone else. We may assign or transfer our rights and obligations to a successor or affiliate.

17. Apple App Store — additional terms

If you download Quizzie from the Apple App Store, the following additional terms apply. In the event of any conflict between this section and the rest of these Terms, this section governs only with respect to your use of the App obtained from the Apple App Store.

• Parties: These Terms are an agreement between you and Hatchgrid only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• Licence scope: Apple grants you a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
• Maintenance and support: Hatchgrid — not Apple — is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
• Warranty: To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; beyond that, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Hatchgrid's responsibility.
• Product claims: Hatchgrid, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including (a) product-liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer-protection, privacy, or similar legislation.
• Intellectual property: In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Hatchgrid, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• Legal compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
